Terms of Service for My 2 Handz Creations

Please read these Terms of Service ("Terms," "ToS") carefully before using the My 2 Handz Creations website (the "Service") operated by U.B.I.G.'s LLC ("we").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. General Conditions and Website Use

  • Eligibility: By using this Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this Site.

  • Accuracy: We are not responsible if information made available on this site is not accurate, complete, or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions.

  • Modification of Service and Prices: Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

2. Products and Services

  • Artisan Nature: You understand and acknowledge that all products—prints, painted clay pots, and hand-painted earrings—are original, handmade works of art. Minor variations in color, size, shape, and pattern are inherent to the creation process and are not considered defects.

  • Color Disclaimer: We have made every effort to display the colors and images of our products that appear on the Site as accurately as possible. We cannot guarantee that your computer monitor's display of any color will be accurate.

  • Product Use: You agree to use the products only for their intended purpose. Specifically, hand-painted clay pots may not be food-safe and should be used at your own discretion.

3. Ordering, Billing, and Account Information

  • Order Acceptance: We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order.

  • Billing Accuracy: You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

4. Shipping and Risk of Loss

  • Shipping Point: All items purchased from the Service are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier (F.O.B. Shipping Point, Fairburn, GA).

  • Delays and Damage: We are not responsible for packages that are lost, stolen, or damaged after they leave our facility. While we will assist in filing claims with the carrier, the customer assumes responsibility once the package is transferred to the shipping service.

5. Returns and Refunds

Our Returns and Exchanges Policy is incorporated into these Terms.

  • Initiation: Returns must be initiated by contacting us within [14] days of receiving your order.

  • Condition: Items must be returned unused and in their original packaging.

  • Non-Refundable: Original shipping costs are non-refundable, and you are responsible for return shipping costs, unless the item was damaged upon arrival. Any item returned damaged or altered (beyond documented transit damage) will be rejected for a refund.

6. Intellectual Property

The Service and its original content, features, and functionality (including but not limited to all prints, photographs, designs, logos, and text) are and will remain the exclusive property of [Your Website Name] and are protected by copyright, trademark, and other laws of both the United States and foreign countries.

  • Copyright Transfer: The purchase of any physical product (print, pot, earrings) does not transfer the copyright or reproduction rights to the buyer. All rights are reserved by the artist.

In no case shall My 2 Handz Creations, our owner, or affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of any of the service or any products procured using the service.

8. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Fulton County, Georgia, for the resolution of any disputes.
